(e) Limited Warranty Information:

I. Limited Warranties

A. SharkLids EyeGear, Inc. (“Seller”) warrants that Product shall be free from defects in material and workmanship under normal use for a period of six (6) months from the date of sale to the original purchaser. Within ten (10) days after discovery of any alleged defect, Buyer must provide to Seller proof of purchase, return of defective Products, and a description of the nature of the problem. Seller's sole obligation and Buyer’s sole remedy under this Limited Warranty shall be to discount, repair or replace, at Seller’s sole option, any Product, which if properly used and maintained, proves defective in material or workmanship. Any Product discounted, repaired, or replaced pursuant to this Limited Warranty will be warranted for the remainder of the original 6-month warranty period. Claiming an alleged defect does not relieve Buyer of any of its payment obligation to Seller.

B. Seller's obligations under this Limited Warranty shall not apply to any part of Products sold hereunder, which (1) are disabled by normal wear and tear or (2) have been damaged due to negligent or faulty use, alteration, maintenance, storage, or handling by Buyer.

C. Any suggestions by Seller or Seller's agents regarding use, application or suitability of Products shall not be construed as an express warranty unless confirmed to be such in writing by Seller.

D. THIS LIMITED WARRANTY IS IN LIEU OF AND EXCLUDES ANY OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. 5. ANY PRODUCTS, WHICH BY AGREEMENT OF THE PARTIES ARE OF LESS THAN SELLER’S STANDARD QUALITY, ARE SOLD “AS IS.”

II. Limitation of Liability

A. Except as otherwise agreed in writing, Seller's liability with respect to Products shall be limited to the warranty provided in Articles I, II and III hereof, and shall be limited to the purchase price.

B. Seller shall not be subject to any other obligations or liabilities, whether arising out of contract, warranty, tort (including negligence and strict liability), or other theories of law, with respect to products sold by Seller or undertakings, acts or omissions relating thereto. Under no circumstances will Seller be liable for any incidental or consequential damages, or for any other loss, damage, or expense of any kind, including loss of profits, arising in connection with the use of Products.

C. Without limiting the generality of the foregoing Seller specifically disclaims any liability for property or personal injury damages, penalties, special or punitive damages, damages for lost profits or revenues, loss of use of Products, or any associated equipment, cost of capital, cost of repairs to Products subject to Seller's warranty performed by persons other than Seller without Seller's prior written consent, cost of substitute Products, facilities or services, down-time or slow-down costs or for any other types of economic loss, and for claims of Buyer's customers or any third party for any such damages.

D. Buyer agrees to cause itself or customers and anybody in the chain of manufacturing, supply and distribution and use including the end customer to be bound by limitations of liability substantially equal to those contained in the language in Articles I, II, and III.

III. State Laws: Some states do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state. You should consult applicable State laws to determine your rights.

Responsibility for Proper Use

It is the buyer and end-user’s responsibility to ensure that this product is used in a manner that is consistent with NFPA 1500, Standards on Fire Department Occupational Safety and Health Program; NFPA 1581, Standard of Fire Department Infection Control Program; 29 CFR 1910.132, “General Requirements of Subpart I, Personal Protective Equipment,” and 29 CFR 1910.1030, “Protecting Health Care Workers from Occupational Exposure to Blood-borne Pathogens”.

Maintenance and Cleaning for Multiple Use (Not Applicable)
